      <![CDATA[According to the <a href="http://www.bostonglobe.com">Boston Globe</a>,Gustavo Pina, 29 of  Saugus  was indicted by a Suffolk County grand jury on Thursday on  22 counts of unemployment fraud. Mr. Pina allegedly collected more than $13,000 in jobless benefits while working. According to Prosecutors  Pina was working full time at a mortgage company while collecting the benefits from August 2007 to January 2008. He earned $24,000 on the job during that period. The case against Mr. Pina is being prosecuted by the Massachusetts Attorney General's Ofiice. 

The charges against Mr. Pina are what are described as white collar offenses. Attorney Patrick Donovan handled white collar prosecution while he was a prosecutor in Norfolk County.

      <![CDATA[According to the <a href="http://www.bostonherald.com">Boston Herald</a> a 63 year old grandmother was charged with her third offense OUI in Marblehead on Friday. Sharon A. Faulkner was allegedly drunk when she got into an accident while she was driving her 9 year old grandson to school. According to the Herald, Marblehead police responded to the report on an car striking an tree. When they arrived they could not find anyone at the scene. Later, school officials reported that Faulkner was involved in the accident. Faulkner failed a series of field sobriety test and blew a .14 on the breathalyzer. This was her third offense for OUI. 

The Herald did not report that Ms. Faulkner was charged with OUI Child Endangerment. That is another serious charge that carries with a mandatory one year license loss and a mandatory minimum jail sentence. If convicted of a third offense OUI the 63 year old grandmother would have to serve 150 days in jail. It is a mandatory sentence.

      <![CDATA[Lorraine Henderson the former regional director for the Department of Homeland Security is set to go to trial in US District Court in Boston. Ms. Henderson was arrested in January 2008 on charges that she knowingly employed illegal aliens at her house. Ms. Henderson faces a possibility of up to 10 years if convicted. 
I can only speculate that because Ms. Henderson was entrusted with the job of keeping illegal aliens out the country and she had three working for her a deal is unlikely.

      <![CDATA[The Worcester County District Attorney's Office lags all other Massachusetts District Attorney's Massachusetts in Superior Court felony convictions. According to a study conducted by Massachusedtts Lawyers Weekly Worcester county had 34% conviction rate. Lawyers Weekly looked at all of the cases that went to trial in Superior Court and considered a conviction anything that resulted at least one felony conviction. If the jury convicted on a misdemeanor only than it considered a loss. 
The average rate of conviction statewide is around 60%. The second lowest rate of conviction is Bristol County.

      <![CDATA[The Suffolk County District Attorney dropped the criminal charges against a former City of Boston laborer in connection with two store robberies. The man who was arrested by the SWAT team in January lost his job because he was held in jail. The District Attorney's office stated that the man was still being investigated in the robberies. The case was heard in the <a href="http://www.pdonovanlaw.com/Massachusetts_Courts/Suffolk_County/Brighton_District.aspx">Brighton District Court</a>. 

It frustrates me to read that the DA's Office is still investigating the suspect after the charges were dropped by the same office. The man in this case already lost his job as a direct result of the case. His name was put through the mud and he was arrested by the SWAT team. Now the office cannot even say it was not him. Lets hope that until there are charges that stick against this man he should at least get his job back.

      <![CDATA[Jillian Baldner of Pembroke Massachusetts was arrested on March 3 for selling what the police believed to be oxycodone. Ms. Baldner was working as a driver for disbaled children at the the time of the arrest. When Ms. Baldner was arrested her infant son and three children with disabilities were in the car. Ms. Baldner was arrainged in the <a href="http://www.pdonovanlaw.com/Massachusetts_Courts/Plymouth_County_Courts/Plymouth_District.aspx">Plymouth District Court</a> and charged with possession of controlled substances, possession with intent to distribute, and conspiracy to violate state drug laws.

      <![CDATA[A man from Maine that police believe was <a href="http://www.capecoddwi.com/First-Offense-OUI.aspx">Operating Under the Influence </a>was summons to court after causing an accident that closed Route 93 in both directions. The major highway linking Boston to the North Shore was closed for about twenty minutes during the morning commute. The driver is alleged to have had an open container of alcohol in the car as well as being under the influence at the time of the accident. The man was issued a summons and taken to the hospital. 
Having an open bottle of alcohol in the car is something that never really plays well when there is an OUI trial. Here where the defendant was taken to the hospital the medical records will show whether the man really was under the influence. In this case the Commonwealth will be able to summons the medical records of the day of the accidents.       <![CDATA[Roberto Perez, 18 of Rockland, Massachusetts was arrested after he allegedly stabbed a sixten year old boy Saturday night. The victim who was stabbed three times had to be airlifted to a Boston hospital. Mr. Perez was charged with armed assault with intent to murder and assault and battery with a dangerous weapon. He is to be arraigned Monday morning in Hingham District Court.  

Mr. Perez is facing very serious charges. Both charges Mr. Perez is facing a felony charges. Now he will be arrainged in the <a href="http://www.pdonovanlaw.com/Massachusetts_Courts/Plymouth_County_Courts/Hingham_District.aspx">Hingham District Court </a>but the Plymouth County District Attorney could easily decide to indict the case. That means that by indicting the case the case would move from the District Court to the Superior Court. Superior Court can then sentence to the Massachusetts State Prisons where District Court can only sentence someone to a County Jail.

      <![CDATA[Anthonhy Scott 47 of Dorchester, Massachusetts  was arrested by the Massachusetts State Police for selling marijuana at Logan Airport. Mr. Scott had worked at the shoeshine stand within Terminal C. After recieving a tip that Mr. Scott had been selling marijuana the Massachusett State Police began their undercover operation. Mr. Scott is alledged to have sold $20 worth of marijuana to an undercover trooper twice and was observed selling marijuana in the airport food court. 

Mr. Scott was arraigned on three counts of distribution of a class d substance in the <a href="http://www.pdonovanlaw.com/Massachusetts_Courts/Suffolk_County/East_Boston_District_Court.aspx">East Boston District Court</a>. Mr. Scott was held on $1000 cash bail and ordered not to go the Logan Airport. 

Distrubution of marijuana is still a misdemeanor criminal offense. The Massachusetts law is as follows: 
Section 32C. (a) Any person who knowingly or intentionally manufactures, distributes, dispenses or cultivates, or possesses with intent to manufacture, distribute, dispense or cultivate a controlled substance in Class D of section thirty-one shall be imprisoned in a jail or house of correction for not more than two years or by a fine of not less than five hundred nor more than five thousand dollars, or both such fine and imprisonment.

      <![CDATA[According to the <a href="http://www.capecodtimes.com">Cape Cod Times </a>the Falmouth police applied for criminal charges against a 7 year first grader for assault and battery on two public employees. The first grader is accused of punching a teacher's aide and pulling the hair of another. 

After the incident the boy was summonsed to the <a href="http://www.pdonovanlaw.com/Massachusetts_Courts/Cape_and_Islands/Falmouth_District_Court.aspx">Falmouth District Court </a>for a show cause hearing before a Clerk Magistrate as to whether criminal charges should issue. If the clerk finds probable cause the charges would issue. 

In this case the clerk did not issue criminal charges against the 7 year old boy.

      <![CDATA[The Boston Police used an undercover police officer to conduct a sting at a Fraternity Party. According to the <a href="http://www.boston.com">Boston Globe</a>, the Boston Police recently had complaints of that the fraternity house. In the past the Boston Police had responded to that house several times with no success they sent an undercover into the house. The undercover police officer was invited into the house for a party. About 75-100 people were at the party ten were later arrested for underage drinking and disturbing the peace.  The students were arraigned in the <a href="http://www.pdonovanlaw.com/Massachusetts_Courts/Suffolk_County/Brighton_District.aspx">Brighton District Court</a>. 

I find it amazing that the Boston Police went so far as to send an undercover police officer to a fraternity party. To me it seems like a lot of work to arrest ten Boston University students for underage drinking. If the police want to stop what was going on in the house they could have charged the residents of the house with Keeping a Disorderly House, a criminal charge. 

I expect that when the arrested partygoers face the Judge in the Brighton District Court they will be able to resolve their cases on either court costs, or community service. Yet the penalties Boston students face by the university could be harsh, including probation and possible expulsion.

      <![CDATA[According to the Boston Globe, the city of Worcester, Massachusetts settled a police brutality lawsuit for $47,500. The city of Worcester agreed to pay the man after he alleged that he was beaten by a baton when he was on the ground. The incident happened outside of a Worcester club, where according to the man his friend got fresh with a police officer. The officer then repeatedly hit the man with his baton bruising him and breaking his wrist. 

Although 47,500 is not the largest settlement of the year it certainly is a win for the man in Worcester.The question I have is where are the criminal charges against the police officer? This is clear assault and battery with a dangerous weapon. That is a felony. The city can pay money but not punish the person who did this.
