Falmouth First Grader Avoids Criminal Charges
According to the Cape Cod Times the Falmouth police applied for criminal charges against a 7 year first grader for assault and battery on two public employees. The first grader is accused of punching a teacher's aide and pulling the hair of another.
After the incident the boy was summonsed to the Falmouth District Court for a show cause hearing before a Clerk Magistrate as to whether criminal charges should issue. If the clerk finds probable cause the charges would issue.
In this case the clerk did not issue criminal charges against the 7 year old boy.
It is obviously wrong to hit a teacher or anyone for that matter, but it is clear that this boy needs help not a criminal record. For the Falmouth police to even file the application for a criminal complaint is an outrage.
