Client gets OUI 4th Offense reduced to a 2nd Offense

I am pleased to report that a client recently had her Operating Under the Influence Fourth Offense reduced to a second offense, allowing her to staying out of jail. The penalty for a fourth offense dwi is a mandatory minimum one year in the House of Correction. That means you cannot get out of jail until one year is served. The standard plea for a second offense is a two week in patient alcohol program. Another major difference is that any offense greater than a second is a felony. A second offense is a misdemeanor. Here the client stays out of jail for a year, and does not leave a convicted felon.
